Terms and Conditions for Hiring Company


By registering and/or participating in the #MyDigitalWorkforce Week – Digital Job Expo, under the Malaysia Tech Month 2021 (“Programme”), organised by Malaysia Digital Economy Corporation Sdn. Bhd. [Company No.: 199601016995 (389346-D)] (“MDEC”), you represent, warrant and agree as follows:

1. You hereby represent and warrant that, with regard to the personal data provided herein for the purpose of the Programme, you have obtained the consent from the relevant individuals for MDEC to process their personal data for the purpose of the Programme and in the manner set out in MDEC’s Personal Data Protection Statement which is available at https://mdec.my/footer-pages/personal-data-protection. You further represent and warrant that you have read and understood the aforesaid MDEC’s Personal Data Protection Statement and agreed to the processing of such personal data by MDEC in the manner set out therein;

2. You further represent and warrant that, with regard to the personal data accessible to you under this Programme, you shall, and shall procure that all your employees, officers and agents to similarly, comply with the Personal Data Protection Act 2010;

3. You acknowledge and agree that the Programme is merely to facilitate job application by the job seekers registered under the Programme, if any, and MDEC is not a party to any job application and matters related thereto. You further acknowledge and agree that MDEC makes no warranties or representations whatsoever, whether express or implied, as to the capability, ability, qualification, accuracy or completeness of the information provided by the job seekers and that any verification of such information shall be your sole responsibility;

4. If you provide any logo or trademark to MDEC for purpose of your participation in the Programme, you hereby grant an irrevocable, perpetual, non-exclusive, transferable, sub-licensable, worldwide and royalty-free license to MDEC to use, host, store, distribute, process, copy, reproduce, publicly display the same, solely for the purpose of the Programme;

5. MDEC makes no warranties or representations whatsoever, whether express or implied, as to the accuracy, suitability, completeness or timeliness of use for any purpose of the Programme, the relevant website or portal, including any materials posted therein;

6. To the maximum extent permitted by law, MDEC shall not be liable for any loss or damage, including without limitation loss of profit, revenue, customer, goodwill or opportunity, loss of data or any other direct, indirect, incidental, consequential, exemplary, punitive or special loss, damage or expense of any kind whatsoever, arising out of or in connection with your use of or inability to use the materials posted herein and/or your participation in the Programme;

7. By registering for and/or participating in the Programme, you represent, warrant and agree that you have read and understood MDEC’s code of conduct which is accessible at https://mdec.my/footer-pages/code-ofconduct/ and agree to be bound by the terms of such code of conduct and you have not breached and shall not breach any of the terms of the code of conduct applicable to you;

8.Nothing contained in these Terms and Conditions shall be construed as granting to you, by implication or otherwise, any license or right to use any of the proprietary rights and/or intellectual property rights owned and/or vested in MDEC or any third party;

9. The Programme may be modified, substituted, suspended, cancelled or terminated at any time; 10. Nothing contained herein shall be construed to imply a partnership, joint venture, principal-agent or an employer-employee relationship between MDEC and yourself;

11. MDEC may update and/or amend these Terms and Conditions at any time by sending a notification email to the email address you provided to MDEC; and if you continue your participation under the Programme, you shall be deemed to have agreed to the latest Terms and Conditions; and
12. The Terms and Conditions herein shall be governed by and construed in accordance with the laws of Malaysia. You agree to submit to the jurisdiction of the courts of Malaysia in the event of any dispute.

Terms and Conditions for Jobseekers

By registering and/or participating in the #MyDigitalWorkforce Week – Digital Job Expo, under the Malaysia Tech Month 2021 (“Programme”), organised by Malaysia Digital Economy Corporation Sdn. Bhd. [Company No.: 199601016995 (389346-D)] (“MDEC”), you represent, warrant and agree as follows:

1. You hereby grant consent to MDEC to process the personal data provided by you herein for the purpose of the Programme and in the manner set out in MDEC’s Personal Data Protection Statement which is available at https://mdec.my/footer-pages/personal-data-protection. You hereby acknowledge that you have read and understood the aforesaid MDEC’s Personal Data Protection Statement and agreed to the processing of such personal data by MDEC in the manner set out therein;

2. You acknowledge and agree that the Programme is merely to facilitate your job application, if any, and any job application is subject to the applicable terms and conditions, criteria, requirements and absolute discretion of the relevant hiring company and that you will have to liaise directly with the relevant hiring company on all matters pertaining to your job application. You further acknowledge and agree that any information or personal data that you provided herein will be accessible to the hiring company participating in the Programme and will be subjected to the hiring companies’ applicable privacy policies;

3. You further acknowledge and agree that under the Programme MDEC makes no representations, warranties or guarantees whatsoever, whether express or implied, about any job posting, any hiring company and/or any job offer or the possibility thereof;

4. MDEC makes no warranties or representations whatsoever, whether express or implied, as to the accuracy, suitability, completeness or timeliness of use for any purpose of the Programme, the relevant website or portal, including any materials posted therein;

5.
